Subsidiary Protection - What is it?

Part 1 of our series: The refugee and integration advice in the spotlight

Our advice for refugees and integration is very often asked what forms of protection there are for people to be able to stay in Germany. Therefore we informing you in a small series of several articles here on our website and also on social media on Facebook and Instagram

The Federal Office for Migration and Refugees - BAMF for short - checks each asylum application to determine whether one of the four forms of protection applies:

  1. entitlement to asylum
  2. refugee protection  
  3. Prohibition of deportation 
  4. Subsidiary protection

In this short article, our counseling staff explains what subsidiary protection is.

Subsidiary protection: This applies if there are valid reasons to believe that people are at risk of serious harm in their country of origin and cannot claim protection from their country of origin. Serious harm can be caused by both state and non-state actors. This means: the imposition or execution of the death penalty, torture, inhuman or degrading treatment, a serious individual threat to the life or integrity of a civilian as a result of indiscriminate violence in the context of an international or internal armed conflict, such as the war in Ukraine. The residence permit is initially granted for one year and, if extended, for a further two years in each case.
